[2] The party affected by the Event of Force Majeure (the "FM Failing Party" ) must promptly after the occurrence of an Event of Force Majeure notify the other Party (the " FM Non-Failing Party") in writing of:
[3] Upon occurrence of an Event of Force Majeure, the FM Failing Party shall be entitled to a reasonable extension of the time for performing such obligations.
(a) relieve the FM Failing Party from any and all sanctions as long as and to the extent that the ground or effects thereof subsist or an agreement is not reached pursuant to the provisions of Article 38.3 (d) below
;(b) postpone the time for performance by the FM Failing Party for such period of time as the ground or effects thereof subsist or an agreement is not reached pursuant to the provisions of Article 38.3(d)
;(c) pending resumption of performance by the FM Failing Party, entitle the FM Non-Failing Party
